Solitary Confinement

I believe that if i was to draft a law regulating the use of solitery confinement i would make it so that the prisoners the have been put in solitary cofinement would be able to defend themselves and be able to prove their point that they shouldnt be put in to solitary confinement without reason and know the amount of time that they will be in solitary confinement.
As what goes for the prison officials i would have there rights be restricted so that they cant do what ever they want when its may be unjustified. i do believe in solitary confienment, but i also believe the prisoners should have some rights while in soliitary confinement. I would allow prisoners to challenge their prison sentence in solitary confinement because prisoners may be prosicuted by suspision and not actual facts. Also i believe that prisoners should be able to take there solitary confinement time to a judge because the prison officials may have a biest opinion on the prisoners while a judge would have a more open mind and take in the prisoners facts and actually think of the prisoner as a person and give them there rights.

Gangs

I don't believe that gangs will ever cease to exist because many of them will not be able to stop becasue that is there life and thats all they know. I do feel that society should be able to put money towards the funds against the gang violence in the cities, along with the funds towards the ending of gang violence in the major cities. Mentally the gangs are not ready to stop their live styles and that they cannot afford to stop selling drugs and illegal weapons.

Death Penalty

I think that death penalty should be allowed because it prevents the citizen that committed the crime from getting out and being able to go commit another crime. Though the death penalty costs alot of money i feel that the government should be able to put a person that committed a crime to death depending on the crime and the intensity of it. I feel that capital punishment is an effective deterrent because it teaches other citizens that if you commit a crime than you will be put to death depending on the severity of the crime. I feel that the biggest benefit of the Death Penalty is knowing that as a citizen you are safer when the citizen that committed the crime is in jail or put to death and that you do not have to worry about them being in your community, depending on the state you live in. I was surprised on how much the average cost of keeping a citizen in jail for one year is so expensive.

Insanity Defense

I believe that the ability to plead insanity is not a good law, in a case that the citizen has commited murder i do not believe that the citizen should be able to plead insanity, the person that commited the crime should not be able to plead insanity because in order to be able to commit murder you have to know what is going on during that time unless it is a "heat of passion" crime.
No, i think that in criminal cases the commiter should not be able to plead insanity because in most cases the commiter has planned out the crime for a period of time and in order to go through with the crime, especially if the commiter has a past record in crime. Insanity is constituted by having a psychiatrist look at the patients history and check if they have any background of insanity and make them go through multiple tests so they can not fake there plead.
My opinion on the Andrea Yates case is that if she is able to kill all five of her children then she should not be able to go away from the facility she is in i dont care if its only during the day or to see her family, i believe she should be in a higher level mental facility in order to make sure she is taking her medicine and doing the right things she should be doing.

Genetics, Poverty, and Media

The main causes of crime that we have been discussing the past couple of days included Genetics, Poverty, and Media. These seem to be the main causes of crime becasue throughout time criminologists have studied because in a more populated yet lower class area more citizens are going to commit a crime rather than in a less crowded upper class area because poverty makes citizens feel that they have to commit crime in order to survive, along with seeing all the crime on the news or in the newspaper makes people feel that they themselves have to commit crime in order to protect themselves in their neighborhood. I personaly believe that media may have a slight impact on the society but not at all a major impact, i believe that people themselvees create crime not society alone depending on the financial state of the community. I think that to prevent the increase of crime we need to stop the "yellow journalism" in the newspaper and on the news. While upper class citizens may feel that since the lower class citizens get foodstamps and welfare that they commit crimes against these citizens because they feel that the government gives lower class citizens get unfair advantages.
